Introduction and Background
Our web site, www.inlondon.com is an Internet service published Welcome Stranger Publishing ltd ("WSP"). In entering our site you are accepting our Terms and Conditions. We may decide to change them at any time and if we do so those changes will be written into these terms and conditions. It is the responsibility of users to be aware of these terms and conditions in case there are any changes. Writing the changes in here is our obligation, keeping an eye on them is yours. Continuing to use the site after a change has been made is your acceptance of the changes.
Use of the Site
You agree to use this site only for lawful purposes, and in a manner which does not infringe the rights of, or restrict or inhibit the use and enjoyment of this site by any third party. Such restriction or inhibition includes, without limitation, conduct which is unlawful, or which may harass or cause distress or inconvenience to any person and the transmission of obscene or offensive content or disruption of normal flow of dialogue within this site.
This site and the information, names, images, pictures, logos and icons regarding or relating to WSP, its products and services (or to third party products and services), is provided "as is" and on an "is available" basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
In no event will WSP be liable for any damages including, without limitation, indirect or consequential damages, or any damages whatsoever arising from use or loss of use, data, or profits, whether in action of contract, negligence or other tortuous action, arising out of or in connection with the use of the site. WSP does not warrant that the functions contained in the material contained in this site will be uninterrupted or error free, that defects will be corrected, or that this site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the materials. The names, images and logos identifying the WSP or third parties and their products and services are proprietary marks of the WSP and/or third parties. Nothing contained herein shall be construed as conferring by implication or otherwise any licence or right under any trademark or patent of the WSP or any other third party.
You and Your Privacy
Information on Visitors
During the course of any visit to www.inlondon.com our server downloads the pages which you wish to see along with something called a Cookie to your computer. Most, if not all, web sites do this, and that's because cookies allow the web site publisher to do useful things like find out that the computer (and probably its user) has visited the site before. This is done on a repeat visit by checking to see, and finding, the cookie left there on the last visit.
Cookies do not identify the user of a computer and by themselves only record what areas of a site a computer has been used to visit. It is possible for anyone to set his or her computer so that cookies are not downloaded from the web site server, but most people do know about cookies and do not block them out. Obviously, if you object to www.inlondon.com - or anyone else - using cookies you should set your computer to block them.
Any information that is supplied by cookies can help us to provide you with a more tailored service and assist us to analyse the profile of our visitors.
What we will and will not do with your information
What we will do is keep a record of your information. Your information will not be passed on to third parties.
However what we will do is slightly different dependant on which service you are using, for a breakdown of these please read the terms and conditions of the relevant service in the "Services" section below. Some may WSP events may be sponsored by third parties or advertisers. In cases like these, your details may be shared for the purposes of the event and if we feel they have information of interest to you. We will not pass on your details without your consent .
Services
Competitions
- On entering a competition (the person, persons or organisation entering the competition) agree to be bound by these terms and conditions and WSP shall only accept submissions (defined below) on that basis.
- WSP reserve the right to substitute an alternative prize of equal value. There is no cash alternative.
- Entries should only be made via the Internet by submitting the official entry form on the competition page within the web site. Entries must be received by 5pm GMT on the closing day of the competition as stated on the competition entry form. No responsibility can be accepted for non-receipt of submitted entries.
- Employees of WSP, their families and agents are not eligible to take part in the competition.
- WSP shall not in any circumstances accept responsibility for the loss, damage or corruption of or to responses to the question ("Response") upon receipt or in transit. (Accordingly WSP will not return any). Responses via the website are deemed to be signed by virtue of having been submitted. Responses must be completed correctly and WSP reserves the right to not accept the response if it is filled in incorrectly.
- WSP reserves the right to withdraw one or more response from the competition at any time and for whatever reason. Furthermore WSP may terminate this Competition before a judgement is made and it will endeavour to notify entrants of the termination and where possible provide an explanation of such a termination.
- WSP reserves the right to change the submission deadline and timetable for whatever reason. WSP will endeavour to inform all entrants of these changes.
- WSP shall at its sole discretion select the winner from the prize draw or answer draw, and for the avoidance of doubt if you submit a correct answer you shall only win the named prize if WSP selects your current answer at its sole discretion.
- By regestering for a competition you accept that you will be subscribed to the inlondon.com e-newsletter.
- All entrants must be 18 or over and resident in the United Kingdom.
- Information gathered in the running of competitions or promotions is not shared with any 3rd party except where the competition or promotion is run in conjunction with a 3rd party and sharing information is necessary to support the event.
Jobs Service
- Clients must register to use the InLondon Jobs service.
- By submitting a vacancy, the Client is authorising WSP to post such vacancy and submit candidates ranked by WSP in accordance with the Client's criteria (if any).
- The Client is responsible for the content of the vacancy and will indemnify WSP against any claim, loss, liability, expense and/or damage ("Losses") in connection therewith.
- WSP does not guarantee that the Client will receive any responses to its displayed job vacancies.
- Applicants' responses will be forwarded by WSP by e-mail subject to any filtering and ranking. The Client is responsible for verifying the information contained in Applicants' responses and WSP accepts no responsibility for the content of any such application. In particular, but without limitation, the Client is responsible for verifying the Applicant's identity, eligibility to work, experience, training, qualifications and authorisations required by the Client, by law or by any relevant professional body for the vacancy.
- The Client shall provide sufficient details about itself and the vacancy to Applicants including without limitation the Client's identity, the nature of its business, the nature of the role, the type of work to be performed, the commencement date, the likely duration, the hours of work, the location, the remuneration, the intervals of payment and benefits, and the notice periods required to be given and received.
- It is the Client's responsibility to protect their computers against any viruses.
- All and any subsequent dealings between the Client and any Applicant and in connection with the Applicant's response to the vacancy are the responsibility of the Client and WSP accepts no liability whatsoever therewith. The Client will indemnify WSP against any Losses in connection therewith.
- The Client will comply with the provisions of the Data Protection Act 1998 in relation to all Applicants' details and indemnify WSP against any Losses in connection therewith.
- The Client will comply with all anti-discrimination legislation including but not limited to the Sex Discrimination Act 1975, the Race Relations Act 1976 and the Disability Discrimination Act 1995. The Client will indemnify WSP against any Losses in connection therewith.
- The Client shall not post any vacancy that directly or indirectly promotes age discrimination.
- The Client, if an employment agency or an employment business as defined in the Conduct of Employment Agencies and Businesses Regulations 2003 ("the Regulations"), will comply with the provisions of the Regulations and the Employment Agencies Act 1973 in relation to all vacancies posted on WSP's site, communications with Applicants and management of Applicants' details and indemnify WSP against any Losses in connection therewith. WSP monitors the quality of vacancies from time to time in order to provide a better service to candidates.
- The Client must satisfy itself of the qualifications and/or authorisations required by law or by any relevant professional body in respect of the vacancy.
- The Client shall not post any vacancy where:
- there is a risk to the health and safety of any Applicant at the location where the work is to be performed, or
- the role involves working with vulnerable persons, including without limitation persons under the age of 18 or persons in need of care and attention by reason of old age, infirmity or any other circumstances.
- The Client accepts responsibility for any detriment which it may suffer or incur in respect of the engagement of an Applicant and shall hold WSP harmless against any Losses in connection therewith. The Client shall use all reasonable endeavours to ascertain that it will not be detrimental to the interests of the Applicant it intends to engage (if any) to work for the Client in the vacancy posted.
- Where the Applicant is to be engaged by the Client in any capacity other than as an employee, the Client undertakes:
- To arrange suitable accommodation and travel to such accommodation if, in order to take up the role, the Applicant must occupy accommodation other than the Applicant's home.
- To include the cost of the return journey if the Client has arranged for free travel or payment of fares for the journey to work, including after the work has finished or where the work does not start.
- The Client warrants that the repayment terms of any loan to an Applicant, in order to meet travel and other expenses, will not require the Applicant to repay a greater sum than the sum loaned.
- By regestering for the jobs service you accept that you will be subscribed to the inlondon.com e-newsletter.
- The Client shall include in the job description the following information:
- Any qualifications and/or authorisations required by law or any or by any relevant professional body;
- If the rate of pay is included, the job description must also include the nature of the work, the location, minimum experience, training and/or qualifications required in order for an Applicant to receive such rate of pay; and/or
- Where the Client is employment agency or employment business, it must state in which capacity it is acting in relation to the vacancy.
- WSP reserves the right in its sole and absolute discretion to remove any vacancy at any time without reason. Examples of vacancies that may be removed include, but are not limited to:
- those that WSP considers illegal, inappropriate or fraudulent
- those that directly or indirectly require or ask for application or registration fees
- those that advertise franchise, pyramid, network marketing or get-rich-quick schemes
- those that have been indiscriminately posted or duplicated across multiple sectors
- those that advertise websites, services, businesses, business opportunities and/or contact details
- WSP reserves the right in its sole and absolute discretion to close any account at any time without reason. Examples of accounts that may be closed include, but are not limited to:
- those that have not provided full or accurate contact or company information
- those that WSP considers to be acting inappropriately or illegally
- those that use inlondon.com to advertise websites, services, businesses and/or business opportunities in any part of the job vacancy or on any part of the site.
- By accessing or using any part, service or feature of this site, the Client agrees to use it in 'good faith' i.e. to post authentic, impartial and unique jobs of reasonable quality, which provide both adequate and accurate job details. The Client also agrees that any abuse of the service, website or these terms and conditions can result in the Client's access to this service being removed, and accounts terminated.
- The Client undertakes not to solicit, or endeavour to solicit, for employment or engagement with itself or any associated company or organisation, any employee of WSP or of any member of the Welcome Stranger Publishing Family (as defined below). Breach of this clause shall be a material breach and will entitle WSP, without prejudice to any other remedies it may have, to terminate the Client's account immediately.
- From time to time WSP will contact Clients in order to evaluate the service they receive and also to promote WSP's posting services and products.
- WSP reserves the right to charge for the postings service as it sees fit and in its sole and absolute discretion, provided that such charge (if any) shall not be retrospective.
- WSP reserves the right to change any aspect of the postings service and/or these terms and conditions, at any time without notice.
e-Newsletter
- Subscription to our e-newsletter is free of charge.
- We do not guarantee that any e-newsletter sent by us is free from viruses or bugs.
- We do not guarantee that subscription to our e-newsletter will mean that you receive our e-newsletter.
- Occasionally we will send out a “solus” e-newsletter on behalf of our advertisers and/or third parties if we feel they have information of interest to you. You may remove yourself from receiving these solus by clicking on the unsubscribe link that will be on the bottom of the e-newsletter, alternatively send an email to solus@inlondon.com with the word unsubscribe in the subject line.
- Subscribers may unsubscribe at any time by clicking on the unsubscribe link at the bottom of the e-newsletter or by emailing newsletters@inlondon.com with the word unsubscribe in the subject line.
Advertising Terms & Conditions
"Advertise" means the party booking the space and is responsible for payment.
"Publisher" means Welcome Stranger Publishing Ltd “WSP”.
- Advertisements must conform to the British Code of Advertising Practice and must accurately reflect the product and or service being advertised.
- Advertisements are subject to the publisher's approval and must always be recognizable as such and not resemble editorial matter.
- All claims made in advertisements must be capable of being supported by appropriate evidence and must be made available to the publisher upon request.
- No guarantee is given that advertisements will be placed in any specified position on any specified page, unless the appropriate surcharge has been contracted and written agreement has been entered into.
- The publication of an advertisement by the publisher does not constitute endorsement of the advertiser, its products or services.
- A signed advertising order confirms you are entering into a contract with WSP.
- Cancellations must be in writing, and can only be accepted up to 28 days prior to publication. All cancellations will incur a 50% cancellation fee. This fee becomes payable immediately on receipt of the cancellation instruction.
- The publisher reserves the right to increase advertisement rates at any time or to amend the terms and conditions at any time.
- The publisher will not be liable for any loss or damage caused by amendment, error, late publication or non-publication from any cause whatsoever.
- The publisher will not accept liability for any error on the part of third parties or inaccurate copy instructions.
- It is the advertiser’s responsibility to supply suitable material to WSP within the deadlines stated on the advertisement confirmation order. If material is not forthcoming, WSP reserves the right to repeat old material, or to charge the client for the advertisement without it appearing. Advertising material must be supplied in digital format, as stipulated by WSP.
- The advertiser agrees to pay standard production rates for any additional work required to make digital material press-ready, including converting open files, or resizing advertisements. Any alterations to material will be charged for.
- Invoices for any advertisements must be settled within 30 days of invoice date. An additional 10% surcharge on the invoice total will be incurred for every 30 day period thereafter if payment is not received.
- Advertisers requiring more than a 30 day payment term must get written confirmation from the publisher prior to reserving the space.
- Should an advertising agency be contracted to manage direct bookings, the value of the initial booking may not be diminished.
- New advertisers will be required to pay for their advertising prior to publication.
"WSP" means all companies connected with Welcome Stranger Publishing Ltd. A company is connected with Welcome Stranger Publishing Ltd if it is:
- a subsidiary or holding company of Welcome Stranger Publishing;
- controlled by the same person(s) who control Welcome Stranger Publishing or Welcome Stranger Publishing holding company;
- a subsidiary or holding company of any company in (i) or (ii) above; or
- a subsidiary or holding company of any company in (iii) above
